DEFINITIONS
In this agreement:
•"Studio" refers to Queens of Pole Fitness & Dance.
•"Member" refers to you, the person whose name and signature appear on this document.
COOLING-OFF PERIOD
You may cancel this Agreement by emailing written notice to admin@queensofpole.com before your first scheduled class. If you cancel before this class, you forfeit your deposit. Refunds, if applicable, will be processed within 14 days and credited to your original payment method.
RISK WARNING
Your participation in the Services may expose you to the risk of death, physical harm, or personal injury. This risk may arise from, but is not limited to, third-party participants, your physical fitness level, tiredness or overexertion, strenuous exercises, your training technique, equipment provided by us, or any failure to comply with our instructions. You acknowledge that death, physical harm, or personal injury may result from your or another party's acts, omissions, or negligence. By participating, you understand and voluntarily accept any risks associated with the Services.
MEMBER OBLIGATIONS
This is a legally binding agreement. Members are responsible for updating their address and contact information. For prepaid memberships, fees are non-refundable. For term memberships, your membership will renew automatically at the end of each term unless cancellation is provided in advance.
MEMBERSHIP AUTO-RENEWAL
Your Weekly Membership will automatically renew at the end of each Billing Cycle. You will continue to be charged the applicable fees for each subsequent Billing Cycle unless you cancel your membership.
ANNUAL PRICE ADJUSTMENT
Each year, starting with Term 1, an automatic 3% increase will be applied to all memberships. This adjustment will apply unless you cancel within the cancellation period.
MEMBERSHIP PAYMENT TERMS
Membership Fees are billed weekly in advance. This billing period is your "Billing Cycle." By enrolling in a Membership, you agree to pay the Membership Fees each week of the Billing Cycle.
CASUAL CLASS BOOKINGS
Casual Pole and Dance Classes are available and must be booked and paid for in full before the class begins. Only specific classes, such as Open Practice, Mixed Pole, and Exotic, are available for casual attendance.
ACCOUNT REGISTRATION & RESPONSIBILITY
When registering for an Account, you must provide basic information including your full name, email address, phone number, date of birth, and an emergency contact. You will also choose a username and password. You are responsible for keeping your Account details confidential, and you are liable for all activity on your Account, including purchases. Notify us immediately of any unauthorized use of your Account.
CANCELLATION
To cancel, submit written notice to your studio (Helensvale: info@queensofpole.com or Ormeau: admin@queensofpole.com) or complete the "Cancel My Membership" form on our website at least 7 business days before the next term to avoid additional charges. Late cancellation may result in a cancellation fee. Any outstanding fees are due up to the cancellation date.
MEMBERSHIP PAUSE
You may pause your membership for a minimum of two weeks and up to four weeks per calendar year. During this time, the pause rate applies. Membership cannot be canceled while paused.
FACILITIES & SERVICES
The Studio reserves the right to update, replace, or discontinue equipment or services without altering this Agreement. The Studio may close for maintenance for up to two weeks per year.
FEE & INCLUSIONS
Membership is non-transferable. Unused portions of memberships are forfeited at the end of the term.
FAILED PAYMENTS
Weekly payments are processed each Thursday. In case of a declined payment:
1.We will re-attempt the payment the next business day and notify you.
2.A $16.90 dishonour fee applies for each initial failed payment.
3.Each subsequent failure incurs a $6.50 processing fee.
4.Access to classes is restricted until all outstanding fees are resolved.
LATE CANCELS & NO SHOWS
All classes have a 90-minute cancellation window unless stated otherwise. Cancellations less than 90 minutes prior or no-shows will result in a $10 fee, billed to your account and debited the following Thursday.
MINIMUM AGE
All members must be at least 14 years of age to join the adult classes, those under 18 may attend only during staffed hours with a parent or legal guardian's consent. Kids classes are for ages 5 years and up at the time of the class
REMAINING CREDITS
Any remaining Class Credits in your Account will expire upon termination or expiration of your Membership or Class Pack.
AUSTRALIAN CONSUMER LAW
a) The Australian Consumer Law (ACL) in the Competition and Consumer Act 2010 (Cth) and similar consumer protection laws may confer rights, guarantees, and remedies relating to our Platform that cannot be excluded, restricted, or modified.
b) If the ACL applies to you as a consumer, these Terms do not exclude your rights under the ACL. Our liability for the Platform to an ACL-defined consumer is governed solely by the ACL and these Terms.
c) Subject to your Consumer Law Rights, we exclude all express and implied warranties, and all material, work, and services are provided without warranties of any kind, express or implied.
d) This clause will survive the termination or expiry of your Membership or Class Pack.
TERMINATION
Memberships operate on an ongoing basis for the period specified in your Account unless either party provides written notice to not renew.
a) Cancellation of Memberships: You may request cancellation with 14 days' written notice. Final payment is required during this period.
b) A Membership will terminate immediately upon written notice by the Non-Defaulting Party if:
•The Defaulting Party breaches a material term and does not remedy it within 10 Business Days of notification.
•The Defaulting Party is unable to pay its debts as they fall due.
c) If we suspect a breach of Terms, we may suspend your access while investigating.
Upon termination or expiry:
1.We will remove your access to the Platform.
2.Any remaining Class Credit Inclusions will expire.
3.Return any property belonging to us that you possess.
4.For termination due to unrectified default, you agree to cover our additional recovery costs.
5.If termination is due to our breach, we will refund prepaid, unused Fees on a pro-rata basis.
6.No refunds are offered on Class Packs.
7.This clause will survive the termination or expiry of your Membership or Class Pack.
LIMITATION OF LIABILITY
Except for cases of legal liability, the Studio Owner is not responsible for indirect, unforeseen, or business losses incurred by Members.
MISCELLANEOUS
This Agreement supersedes any previous agreements and can only be modified by mutual, written consent.
PAYMENT AUTHORISATION
By agreeing to this, you authorise Queens of Pole Fitness & Dance to charge your Membership Fees weekly or pay in full until written cancellation. Unauthorized termination may result in liability for damages due to breach of contract.
CANCELLATION DUE TO MEDICAL REASONS
Direct Debit Membership (other than Casual Memberships): You may cancel your upcoming direct debits upon receipt of a valid Medical Certificate. Please note that any debits that occurred before this certificate was received are non-refundable.
Pay in Full: You may cancel your membership upon receipt of a valid Medical Certificate, your refund will be provided as a refund or system credit for the remainder of your fees paid, from the next available payment date (ie. part week refunds are not provided. Memberships are considered week to week and refunds will be provided per week to week timeframe) that you are welcome to use at Queens of Pole Fitness & Dance when you are ready to come back to classes.
MID TERM CANCELLATIONS
Due to the fact that our courses are considered single unit products, once a course has commenced we are unable to offer your surrendered position to another customer. Therefore we consider your continued enrolment in any course past the scheduled first class as having used your fitness service and so are unable to offer refunds on course fees after the first scheduled class.
Once a Term has commenced, debits are unable to be cancelled, credited or refunded. If you would like to cancel your enrolment in preparation for the end of the current term, please complete the cancellation link available on members page website before the end of Week 8, of any of our terms and debits will be cancelled at the end of the term, or once the equivalent value of debits has been paid if debits have declined.
